This AUCTION is being conducted pursuant to the Provisions of Chapter 2 of the Dallas City Code.  Attendees, whether bidding or not, are required to register prior to the Auction.  In order to register, you MUST be 18 years old or older and have a VALID driver’s license or a state issued ID card.  The Auctioneer reserves the right to reject the bid of anyone who is not a registered bidder.  The City reserves the right to refuse any bid considered unreasonable.

“Pursuant to the Dallas City charter, all item (s) that exceed $20,000.00 threshold require the City of Dallas, City Council approval and will require the bidder to have a hold place on the items (s) purchased for approximately 6 to 8 weeks prior to delivery.” The City of Dallas, City Council must approve the purchase.”

IMPORTANT NOTICE EFFECTIVE 09/12/16:
A buyer's premium of 5.5% will be collected at settlement from ALL WINNING BIDDERS for ALL INVOICES.

It will be necessary to execute a “Certificate of Resale” for all items purchased by Dealers of Resale with sales tax permit number. Failure to furnish this information at registration will require payment of sales tax on all purchases other than titled vehicles.

City Auto Pound auctions starts at 10:00 a.m. Registration is from 8:00 a.m. – until the last item has been sold.  ONLY, registered Bidders may inspect the vehicles starting at 9:30 a.m. 

ALL ITEMS ARE SOLD “AS IS” WITH NO WARRANTIES STATED OR IMPLIED.  ALL SALES ARE FINAL.  Neither the City nor the Auctioneer is responsible for any loss or damage.

ALL PURCHASES MUST BE PAID IN FULL NO LATER THAN ONE-HOUR AFTER THE CONCLUSION OF THE AUCTION. 

Anyone failing to make settlement in full on Auction day will be required to post a deposit in the amount of  bid, or banned by the City of Dallas from the City of Dallas Auctions for minimum of six months.  Repeated offenses at City of Dallas auctions will result in a permanent ban from all City of Dallas Auctions. To be determined by the City Sales Agent.

BEGINNING JULY 8th, 1996:

Payment is to be made by CASH, CASHIERS CHECK, or PERSONAL/COMPANY CHECK, an accompanied by a bank letter of guarantee.  Checks must be made payable to the CITY OF DALLAS.  No wire transfers or bank drafts will be accepted.  Bank letter must be an ORIGINAL on bank letterhead and must read “          (customer’s name) is a customer of this bank.  This bank will guarantee unqualified payment to the City of Dallas on the account #               up to the amount of $                        .  This letter expires                 (date). “Expiration date must be so stated at a two-week minimum (after each auction), but may be increased to six months or a year).
ALL BANK LETTERS WILL BE VERIFIED By the City of Dallas. There will be a $25.00 return check fee.

Auctions sales receipts will be mailed to the name and address on the buyer’s invoice within seven to ten working days after the auction for buyers who pay cash.  Auction sales receipts will be held for 15 working days for buyers who pay by check.

At the time of the Auction, the buyer’s number and price of items sold is announced by the Auctioneer.  No changes in price or quantity can be made by anyone but the Auctioneer or City of Dallas staff in consultation with the Auctioneer and at that time only.  In any dispute over price or quantity between bidders, the Auctioneer reserves the right to settle any all disputes and his/her decision shall be final.  Announcements made by the Auctioneer on the day of the Auction take precedence over any printed matter pertaining to this auction.  Despite our efforts to avoid withdrawal of items from the list after they are advertised, it may be necessary.  Therefore, the City of Dallas reserves the right to do so.    

*All auction vehicles sold must be removed from the auto pound by licensed Wrecker.  No auction vehicle will be driven from the Auto Pound.  Do not park your purchases in the pound parking lot.  Do not remove any items from the vehicles and leave on City premises.  Any person stealing from vehicles will be arrested, put in jail and banned permanently from attending any future auctions of the City of Dallas and Auctioneers.

No repair will be performed on any vehicle or keys made until payment is completed

CHECKOUT:  The Police Auto Pound is open 24-hours for removal of items.  You must remove vehicles no later than 11:59 p.m. the day following the Auction.  All items not removed by deadline will be assessed a daily storage fee.  Any vehicle(s) not removed by the following Auction will be resold at the following Auction.

In the event of tie-bids (two or more bidders claiming the high bid when an item is pronounced “SOLD” by the Auctioneer), the bidding will be reopened between those that are tied and will continue until a single high bidder has been established. Only those bidders recognized by the Auctioneers or bid spotters will be involved in tie-bids.

All persons attending the Auction will remain in the designated Auction area.  Do not pass beyond the red traffic cones or the yellow barrier tape that designate the outer boundaries of the Auction area.  Any person trespassing beyond these boundaries will be immediately removed from the Auto Pound premises.
